The General Data Protection Regulation (GDPR) is a regulation in EU law on data protection and privacy for all individuals within the European Union.
The GDPR repeals the EC Directive 95/46 on the protection of individuals with regard to the processing of personal data and the free movement of such data which was enacted into UK law by the DPA 1998 in 2000.
The GDPR came into force on the 25 May 2018 and applies to personal data which means any information relating to an identifiable person who can be directly or indirectly identified in particular by reference to an identifier.
In the UK, the new Data Protection Act 2018 also received Royal Assent on 24 May 2018 and some of the provisions under the DPA 2018 also came into force on 25 May 2018.
The DPA 2018 is the UK’s third generation data protection law and repealed the DPA 1998 with effect from 25 May 2018.
What is the difference between the DPA 2018 and the GDPR?
The GDPR has direct effect across all EU member states and has already been passed. This means schools, academies and public authorities will still have to comply with the GDPR for most legal obligations. However, the GDPR gives member states limited opportunities to make provisions for how it applies in their country.
One element of the DPA 2018 is the details of these are being enacted into domestic legislation by Parliament. It is therefore important the GDPR and the DPA 2018 are read side by side.
